Terms of Service

These Terms of Service (the “Terms”) are a legal agreement between you and Artists For Unity Inc (“Artists For Unity,” “AFU,” “we,” “us,” or “our”), a nonprofit organization based in Irvine, California, recognized as a tax-exempt charity under Section 501(c)(3) of the Internal Revenue Code (EIN 99-4993653). They govern your use of this website (the “Site”) and any donation you make through it. Please read them carefully.
By accessing or using the Site, or by making a donation, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.
1. Who May Use the Site
You may use the Site only if you can form a binding contract with us and are not barred from doing so by law. You must be at least 18 years old to make a donation. If you use the Site on behalf of an organization, you confirm that you have the authority to bind it to these Terms.
2. About the Site
The Site shares information about our mission, our founder, our exhibitions, and the ways to support our work. It is provided for general information. Descriptions of our programs, projects, partners, timelines, and results reflect our plans and understanding at the time they are written, and they may change.
The Site mentions fundraising goals, such as the amount we are working to raise for the next phase of our work. A goal is a target, not a promise or guarantee that we will reach it or that any particular project will be completed on a particular schedule.
3. Donations
How donations are processed. Donations are made through a checkout operated by Double, our donation platform, with payments processed by Stripe. By donating, you also agree to the terms of those providers that apply to the checkout. Card and bank details are handled by those providers and not by us. Processing fees charged by payment providers may reduce the net amount we receive.
Tax treatment. Artists For Unity Inc is a registered 501(c)(3) charitable organization (EIN 99-4993653). Contributions are tax-deductible to the extent allowed by law. We will send a receipt to the email address you provide. No goods or services are provided in exchange for a donation unless we state otherwise at the time of the gift. Please consult your own tax advisor about how the law applies to your situation.
Funding opportunities and recognition levels. The Site describes funding opportunities named Cornerstone, Chain Builder, Room Opener, and First In. Where a funding opportunity includes benefits, such as a private preview of an exhibition, a signed print, event access, or recognition as a founding supporter, the portion of your gift that is tax-deductible is the amount that exceeds the fair market value of those benefits, and your receipt will say so. Benefits depend on availability and scheduling. We may substitute benefits of comparable value if an event or item becomes unavailable. A description of a benefit on the Site is not a guarantee of a specific date, location, or edition.
Recurring donations. If you choose to give on a recurring basis, you authorize us and our payment providers to charge your payment method at the frequency you select until the donation ends or you cancel. You can cancel or change a recurring donation at any time by emailing us at artistsforunityinc@gmail.com or by using the manage-donation link in your receipt email, if one is included. Cancellation applies to future payments only.
Refunds. Donations are generally non-refundable. If you made a donation by mistake, gave the wrong amount, or did not authorize a charge, email us within 30 days of the donation and we will review your request. Approved refunds are returned to the original payment method.
Use of funds. We use donations to carry out our charitable mission, as our leadership decides. If you designate a campaign or purpose, we will honor your preference where we reasonably can, but a designation is a non-binding request unless we have agreed to it in writing. If a designated project is changed, delayed, or cannot be completed, or if it receives more funding than it needs, we may use the funds for a similar charitable purpose within our mission.
Fraud and errors. We may decline, reverse, or refund a donation that we reasonably believe to be fraudulent, unlawful, or made in error.
4. Acceptable Use
You agree to use the Site lawfully and respectfully. You may not:
use the Site in a way that violates any law or the rights of others;
attempt to gain unauthorized access to the Site, our systems, or our providers’ systems, or interfere with their security or operation;
use bots, scrapers, or other automated tools to copy or collect content or information from the Site, except for ordinary search-engine indexing;
make donations with a payment method you are not authorized to use, or test the checkout with stolen or invalid payment information;
use the Site to harass, threaten, or promote hatred or violence against any person or group, or to send us unlawful or abusive messages; or
misrepresent your identity or your affiliation with us.
5. Content on the Site
Our content. The Site, including its text, photographs, video, graphics, logos, exhibition materials, design, and code, belongs to Artists For Unity or its licensors and is protected by copyright, trademark, and other laws. We grant you a limited, revocable, non-exclusive, non-transferable license to view the Site and share links to it for personal, non-commercial purposes. You may not copy, modify, distribute, sell, or create derivative works from our content, or use our name or logo, without our prior written permission.
Participants’ and third-party content. Photographs, artwork, and statements of exhibition participants and public figures, and other third-party materials, remain the property of their respective owners and appear on the Site with permission or as otherwise allowed by law.
Hateful messages shown on the Site. Our work documents antisemitism. The Site displays screenshots of hateful comments and messages that were sent to our founder, in which we obscure the names and profile photos of the senders. They contain offensive and disturbing language. We show them to document harassment and raise awareness, and not to endorse them. Please do not republish them in a way that identifies the people who sent them. If you appear in material on the Site and want it corrected, further obscured, or removed, email us at artistsforunityinc@gmail.com.
6. Communications
If you email us or message us on Instagram, you agree that we may reply to you using the contact information you provide. You will not receive promotional messages from us unless you ask for them or have given us permission, and you can opt out at any time.
Any feedback, ideas, or suggestions you send us may be used by us without restriction or compensation to you, though we will not publish your name or personal information without your permission.
7. Third-Party Services and Links
The Site links to and relies on services we do not own or control, including Instagram, Double, and Stripe. Your use of those services is governed by their own terms and policies, and we are not responsible for their content, availability, or practices.
8. Privacy
Our Privacy Policy explains how we collect, use, and share personal information. By using the Site, you acknowledge that you have read it.
9. Disclaimers
To the fullest extent permitted by law, the Site and everything on it are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the Site will be uninterrupted, secure, or error-free, or that the information on it is complete or current. Nothing on the Site is legal, tax, financial, or other professional advice.
10. Limitation of Liability
To the fullest extent permitted by law, Artists For Unity and its directors, officers, employees, volunteers, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising out of or related to your use of the Site or these Terms, even if we have been told such damages are possible. Our total liability for any claim relating to the Site or these Terms is limited to the amount you donated to us through the Site in the twelve months before the claim arose, or $100 if you made no donation in that period.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.
11. Indemnification
You agree to defend and indemnify Artists For Unity and its directors, officers, employees, volunteers, and contractors against claims, damages, and reasonable expenses, including attorneys’ fees, arising from your violation of these Terms, your misuse of the Site, or your violation of any law or the rights of another person.
12. Suspension and Termination
We may suspend or restrict your access to the Site at any time, without notice, if we believe you have violated these Terms or if we need to protect the Site, our community, or others. Sections that by their nature should continue after termination will continue, including those on content ownership, disclaimers, limitation of liability, indemnification, and governing law.
13. Governing Law and Disputes
These Terms and any dispute relating to them or the Site are governed by the laws of the State of California, without regard to its conflict-of-law rules. Before filing a claim, you agree to contact us at artistsforunityinc@gmail.com and give us 30 days to try to resolve the matter informally. If we cannot, the state and federal courts located in Orange County, California have exclusive jurisdiction, and you and we consent to the personal jurisdiction of those courts.
14. Changes to These Terms or the Site
We may update these Terms from time to time. When we do, we will change the “Last updated” date at the top of this page, and for material changes we will post a notice on the Site. Your continued use of the Site after an update means you accept the updated Terms. We may also change, suspend, or discontinue any part of the Site at any time.
15. General
These Terms and our Privacy Policy are the entire agreement between you and us about the Site and supersede any earlier understandings on that subject. If a court finds part of these Terms unenforceable, the rest will remain in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our written consent, and we may assign them to a successor organization. By using the Site, you consent to receive legal notices from us electronically, including by email or by posting them on the Site.
